General

The Particulars form part of these Terms and Conditions. Each Entrant agrees and acknowledges that they have read these Terms and Conditions and that entry into this Promotion constitutes acceptance of these Terms and Conditions.

Entries must comply with these Terms and Conditions to be valid.

All capitalised terms used in these Terms and Conditions have the meaning given in the Particulars, unless stated or as the context otherwise provides.

If there is any inconsistency between these Terms and Conditions and any other documents or information that refers to this Promotion, these Terms and Conditions prevail.

These Terms and Conditions will be made publicly available, including on the Promotor’s website and at the place/s where the promotion is being conducted.

If there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each Entrant and no correspondence will be entered into.

Eligibility & Entry  

Entry is open to all persons who meet the Eligibility Requirements and comply with the Entry Procedure during the Promotion Period, as specified in Items 3, 4 and 5 of the Particulars, except for:

the directors, management, officers, contractors, employees of the:

the Promoter;

any person or entity involved in determining the winning Entrant; or

any other person, company, supplier or agency associated with the Promotion, including a Benefiting Organisation, if applicable; and

a spouse, de facto spouse, partner, guardian, parent, child or sibling (whether natural or by marriage or adoption) of any person referred to in clause 6(a).

(Entrants)

Entrants may enter the Promotion up to the Maximum Number of Entries.

All entries are deemed received at the time of receipt by the Promoter, not at the time of transmission by the Entrant.

Entrants must not engage in conduct in entering the Promotion which, in the opinion of the Promoter, is unlawful, fraudulent, misleading, deceptive, intended to jeopardise the fair and proper conduct of the Promotion or is generally damaging to the goodwill or reputation of the Promotion and/or Promoter.

If the Promoter, in its absolute and sole discretion, determines that an Entrant has breached any part of these Terms and Conditions, the Entrant will be disqualified, their entry will be void and their claim to the Prize will be invalidated. The Promoter reserves the right to request whatever documentation it deems necessary to confirm or deny its suspicions in this regard and any failure to provide such requested documentation to the Promoter, gives the Promoter the right to disqualify the Entrant.

If the Prize has been awarded and collected before the Promoter identifies that the winning Entrant has breached any part of these Terms and Conditions, the Entrant must immediately return the Prize to the Promoter on demand at the winning Entrant’s own cost. The Promoter’s legal rights to recover damages or other compensation from any offender are reserved.

The Promoter reserves the right in its absolute and sole direction to request the winning Entrant to provide proof of identity, proof of residency and any other document reasonably required by the Promoter to verify the winning Entrant satisfies the Eligibility Requirements. If the winning Entrant cannot provide suitable proof, they will forfeit the Prize in whole and no substitute or compensation will be offered.

The Promoter accepts no responsibility for any late, lost, misdirected, delayed, ineligible, incomplete or corrupted entries or delays in the delivery of entries due to technical disruptions, network congestion or for any other reason.

Draw and Notification of Winner

The Prize draw to determine the winning Entrant for the Promotion will be conducted in accordance with the Draw Details.

If any part of the Prize draw is scheduled on a weekend or public holiday, the draw will be conducted on the following business day.

The winning Entrant will be notified in accordance with the Winning Entrant Notification.

It is a condition of entry into the Promotion that Entrants consent to the publication of their name on social media platforms if they are the winning Entrant and they participate in any media releases which may include photographs/images, audio-visual clips/voice, as recorded, photographed or filmed of the winning Entrant by the Promoter (the Materials). By entering this Promotion, Entrants consent to such publication and:

permit the Promoter to use, reproduce, edit and communicate to the public, the Materials;

permit the Promoter to licence, authorise otherwise transfer the rights in the Materials to third parties for the same purpose;

unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials; and

waive all moral rights in the Materials, in any media whatsoever throughout the world for an unlimited period of time and the winning Entrant will not be entitled to any fee or compensation.

If an Entrant’s contact details change during the Promotional Period, the Entrant must notify the Promoter in writing to the contact details specified in Item 1 of the Particulars. A request to access or modify any information provided in an entry should be sent to the Promoter. The Promoter shall not be responsible for any failure to contact a winning Entrant in circumstances where the winning Entrant failed to advise the Promoter of their updated contact details.

As the Promotion is a game of chance and subject to these Terms and Conditions, skill plays no part in determining the winning Entrant and each valid entry will not be individually judged. Each entry has an equal chance of winning.

Prize  

The Prize is identified in Item 8 of the Particulars.

The Prize is not transferrable and not redeemable for cash.

The Prize will be delivered by eft however the participant must come and present the novelty cheque which will be provided.  

If the Prize is unavailable for whatever reason including (without limitation) due to causes beyond the control of the Promoter, including but not limited to natural disasters, acts of God, civil unrest, strike, war, act of terrorism, epidemic or pandemic, or public health order, the Promoter reserves the right in its absolute discretion to substitute the Prize for a Prize of equal or greater value, subject to State and Territory legislation and/or direction from a regulatory authority. It is a condition of accepting the Prize that the winning Entrant must comply with all the conditions of use of the Prize and the Promoter’s requirements. The Prize must be taken as stated and no compensation will be payable if the winning Entrant is unable to use the Prize as stated.

Entrants are responsible for any and all expenses incurred when entering the Promotion and accessing, claiming and/or using the Prize unless otherwise stated in these Terms and Conditions.

Unless otherwise expressly stated, the Prize value is based on the recommended retail prices in Australian Dollars at the time of first publication of these Terms and Conditions (inclusive of GST). The Promoter accepts no responsibility for any change in the prize value between now and the actual Prize redemption date.

The winning Entrant should seek independent financial advice at their own expense regarding any tax implications relating to the Prize or acceptance of the Prize.

The Prize may not, without the prior written consent of the Promoter, be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion, or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If the Prize is sold or used in breach of this condition, the Promoter may withdraw the prize in its absolute discretion. Where the Prize has been withdrawn in accordance with this clause, no refund, substitute or compensation will be offered.

All Entrants agree that if they win the Prize, they, nor their spouses, family members or friends will sell or otherwise provide their story and/or photographs in relation to the taking of the Prize, to any media or other organisation, without the Promoter’s prior written consent. Photographs will be allowed to be taken by the winning Entrant only at the discretion of the Promoter.

Claiming Prize and Redemption Date

The winning Entrant must claim the Prize within the period specified in Item 11 of the Particulars and receive the Prize within the period specified in Item 12 of the Particulars and in the event the winning Entrant does not comply with this clause, the Prize will be:

forfeited by the winning Entrant and no substitute or compensation will be provided by the Promoter; and

re-drawn in accordance with Item 11 of the Particulars without further notice to the winning Entrant.

Limitation of Liability

The winning Entrant releases the Promoter and other organisers, their related bodies corporate, affiliates/related entities, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with their participation in the Promotion or the acceptance of, and use of the Prize. Without limiting the foregoing, the released parties will not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred.

Privacy

The Promoter complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Details from entries will be collected, used and stored for the purposes of conducting this Promotion (which may include disclosure to third parties for the purposes of processing and conducting the promotion) and for promotional purposes surrounding this Promotion.

By entering this Promotion, Entrants consent to the use of their personal information and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, publicity purposes and (if the Entrant has consented) marketing without any further reference or payment to the Entrant and otherwise in accordance with its privacy policy which is accessible at Privacy Policy – Eagers Automotive

Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by contacting the Promotor on the email address specified in Item 1 of the Particulars or in the privacy policy.

General

These Terms and Conditions may be amended or replaced from time to time, including if required by any regulatory authority, and notice of such amendment will be made public, including by notice on the Promoter’s website.

Failure by the Promoter to enforce its rights under these Terms and Conditions does not constitute a waiver of those rights.

These Terms and Conditions represent the entire agreement between the Promoter and the Entrants (including the winning Entrant) with respect to the Promotion and supersede any prior agreement, understand or arrangement between the Promoter and the Entrants (including the winning Entrant), whether oral or in writing.

The Promoter excludes all warranties, guarantees or representations (whether express or implied) except as expressly provided in these Terms and Conditions.

Any provision of these Terms and Conditions which is or becomes void, voidable, unlawful or unenforceable in any jurisdiction will, as to that jurisdiction, be severed from these Terms and Conditions and the remainder of these Terms and Conditions will continue in full force and effect.

These Terms and Conditions are governed by the laws of Queensland. Entrants submit to the exclusive jurisdiction of the Courts of this state.
